The incident happened at around 9:20 p.m. Saturday, Sept. 9, in Shirley, on the Sunrise Highway Service Road near Maple Avenue, according to Suffolk County Police.

Investigators said Kimberly Diaz, age 27, of West Babylon, was driving a GMC Yukon eastbound on the service road when she lost control and crashed into a utility pole. No other vehicles were involved.

When Suffolk County Police Highway Patrol officers arrived, they determined that Diaz was intoxicated and arrested her.

Her two sons, ages 7 months and 7 years, were taken by ambulance to Stony Brook University Hospital and treated for minor injuries. They will be released to the custody of a grandparent.

At the time of the crash, Diaz did not have an active driver’s license.

She also had an Interlock device, which are often ordered by judges when someone has a DWI conviction and are supposed to prevent drivers from operating a car without a breathalyzer.

Diaz is charged with the following:

  • Aggravated driving while intoxicated with a child passenger 15 years or younger (Leandra’s Law)
  • Driving while intoxicated
  • Aggravated unlicensed operation of a motor vehicle
  • Two counts of endangering the welfare of a child
  • Circumvent Interlock device

She was expected to be arraigned at First District Court in Central Islip on Monday, Sept. 11.

Detectives are asking anyone with information in the case to contact the Suffolk County Police Department at 631-852-8752.
